Reduction of Transport Load Fee
Chairman McNutt called the meeting to order shortly after 10:30 a.m. Roll was called to verify Trustees’ attendance.
Chairman McNutt invited Ms. Eighmey to summarize the question before the Board regarding reduction of the transport load fee. She reminded Trustees of their decision in April to announce their intent to reduce the fee from $40 to $20 per 8,000 gallons, effective September 1. She reviewed the discussion at the May meeting, in which the Trustees indicated they wanted to defer final action on the proposed reduction until Governor Blunt took action on SB907. She noted that the Governor signed the bill on July 10, 2008, and said the Department of Revenue needs adequate time to prepare for the change, which necessitated the conference call.
Tom Kolb moved to lower the transport load fee to $20 per 8,000 gallons, effective September 1, 2008. Ski Mariea seconded.
Richard AuBuchon connected to the conference call at this time and was briefed on the motion being considered.
A roll call vote was taken; the motion carried without dissent.
New Third-Party Claim - Engage Attorney
Ms. Eighmey asked the Board to consider one additional matter, reporting that a new third-party lawsuit had been filed against MFA Petroleum Company by a neighbor adjacent to one of MFA’s convenience stores. She noted the PSTIF is obligated to provide a defense and that, due to the requirement to respond to the petition within 30 days, it would be helpful if the Board would agree to engage counsel now. She said she had conferred with Dan Atwill, who had talked with MFA’s corporate counsel; it was recommended that Jeffrey Blaylock of Ford, Parshall & Baker, LLC, be engaged to defend the PSTIF participant in this case.
Tom Kolb moved to engage Jeffrey Blaylock, Ford, Parshall & Baker, LLC, to defend the PSTIF’s insured, MFA, in the Willis v. MFA lawsuit recently filed. Rich AuBuchon seconded. There was a brief discussion, including review of Mr. Blaylock’s hourly rates.
Danny Opie left the conference call.
On a roll call vote, the motion carried without dissent.
Rich AuBuchon announced he would be leaving the Office of Administration to serve as Chief of Staff and General Counsel for the Lieutenant Governor, and that Trent Summers would attend the July 23 Board Meeting on behalf of OA. Chairman McNutt, Ms. Eighmey and Trustees thanked Mr. AuBuchon for the time and expertise he had given to the Board and its work.
Chairman McNutt thanked the trustees for making time for the telephone conference call and adjourned the meeting at approximately 10:50 a.m.
